Planning appeal against Exeter City Council successful

Having had an initial scheme refused and a revised scheme also refused for a new dwelling in Exeter (despite the revised scheme addressing the initial reasons for refusal), both refused applications were submitted to the Planning Inspectorate as a joint appeal. The Inspector felt that the first scheme was acceptable with the exception of one matter regarding overlooking, so this scheme was not approved, however the revised scheme was absolutely acceptable and therefore approved. Furthermore, the Inspector agreed with us that Exeter City Council Planning Department had behaved unreasonably, stating "To insert a reason for refusal based on conjecture is to my mind an example of unreasonable behaviour on the part of the Council". I look forward to this house being constructed in 2016 and I hope the Council does not make it so difficult to get schemes approved in future and work in a more positive and proactive manner.
